At Abhilasha, we are committed to enlightening women on all matters concerning their legal rights, empowering them to gain confidence and take charge of their lives and encouraging their progress & growth into becoming strong, powerful women. We provide free online legal advice and counselling to women within 48 hours of submission of the query in matters concerning family and livelihood issues: marriage, children, adoption, surrogacy, domestic violence, divorce etc.; succession & property issues; issues concerning cybercrimes and any other concerns/disputes that cause them to feel wronged or discriminated against. Our aim is to foster a safe and confidential environment for women to voice out their concerns and explore the remedies available under law.

KNOW YOUR RIGHTS

There are two major hurdles that hinder the development of strong, empowered women: ignorance and illiteracy. Society perpetuates harmful practices, regressive mindsets and blind adherence to discriminatory customs in a manner that breeds fear and ignorance amongst women. Lack of knowledge regarding their rights also causes women to endure pain and suffering and prevents them from making strides in all facets of life. Abhilasha believes that women are best empowered when they are educated of their rights. A well-read woman is not only a boon for herself, but also for the members of her family, her children and society at large. We have provided a brief list of women-related legislations in the country that are aimed at strengthening women in all walks of life:

General Rights:

  • Legal Services Authorities Act, 1987 – Under the Act, free legal aid can be provided to women/children that have a requirement to file/defend a case.
  • Indecent Representation of Women (Prevention) Act, 1986 – The Act punishes women’s indecent or derogatory depiction in advertisements, writings, paintings or any other manner.
  • Immoral Traffic (Prevention) Act, 1956 - This Act aims to stop immoral trafficking of women and children as well as prostitution in India.
  • Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994 - Through the Act, sex-selection techniques after conception and misuse of prenatal diagnostic techniques for sex-selective abortions was banned.
  • Criminal Law (Amendment) Act, 2013 – By way of this new amendment, several new offences have been recognized and incorporated into the Indian Law including: acid attack, voyeurism, stalking, cyber stalking etc.

Family Rights:

  • Various laws governing Marriage, Divorce, Custody, Succession and Child related rights.
  • The Protection of Women from Domestic Violence Act, 2005 – Law enacted to protect women from domestic violence including physical, emotional and psychological abuse.
  • Dowry Prohibition Act, 1961 - The Act prohibits and punishes the practice of giving or taking of dowry by any party in the marriage.
  • Medical Termination of Pregnancy Act, 1971 – Provisions are made for safe and legal access to abortion services in specialized circumstances.
  • Prohibition of Child Marriage Act, 2006 - As the name suggests, the Act prohibits and punishes child marriages in India.
  • Section 125 of Code of Criminal Procedure, 1973 - Provides for maintenance to wife, children and parents if they are not able to maintain themselves.

Workplace Rights:

  • Maternity Benefit Act, 1961 - The Act and its recent amendment in 2017 further protects the employment of women during her maternity and provides for increased maternity benefits – paid absence from work to take care of her child.
  • Equal Remuneration Act, 1976 - Through this Act, the employer is prohibited from discriminating on the basis of gender and is duty bound to pay equal remuneration to men and women workers.
  • Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 - Protects women against sexual harassment of women at the workplace as well as prevention and redressal of complaints of sexual harassment.

Rights Against Cybercrimes:

The IT Act, 2000 punishes various cybercrimes against women including violation of privacy: transmitting private images without consent, sharing obscene content or sexually explicit material. Recent rules have strengthened the power of the authorities to take action against objectionable content posted online.
